Business Hours & Sessions:
Red Amp Audio's normal hours of operation are 9:00AM to 5:00PM EST Monday through Friday. Studio tours must be scheduled during these hours. Studio sessions may be scheduled during other hours and days, including evening hours and weekends but no late night hours will be offered.
Session set up time, session break down time, recording, mixing, importing, creating and exporting files are all considered part of the project and are billable hours. The clock starts for each session at the requested time held for the session regardless of the time the Client arrives to the session.
No entourages / family / friends are allowed in the studio. Only the musician(s) and/or vocalist(s) and their producer(s) and manager will be allowed in the studio with our engineer during sessions. No smoking, drugs, guns or other weapons are allowed inside the studio.
A Red Amp Engineer or Red Amp Producer must be present at all sessions and are the only people allowed to engineer.
In the event of equipment malfunction, Red Amp Audio is not liable for consequential or any other damage that may result.
A 50% deposit or a 2-hour minimum deposit (whichever is greater) is required to confirm all sessions. Deposits are non-refundable.
There is a 2-hour minimum for all sessions. After the initial two hours, all charges are billed in half hour increments (or any portion thereof).
HOLD Sessions, CONFIRMED Sessions and Cancellations:
Sessions placed on HOLD are not confirmed sessions until a deposit it received. All HOLD sessions must be confirmed no later than 48 business hours prior to the session or they will be removed from the schedule. A HOLD may be challenged for a confirmed booking. If a HOLD is challenged, the session must either be confirmed or released at the time of the challenge by the holding Client. The challenging Client will then be charged a minimum of 100% of the requested hours regardless of the amount of time actually used.
Sessions are only confirmed when a non-refundable deposit is received in full by Red Amp Audio. CONFIRMED sessions that are cancelled or postponed 48 business hours or more in advance of a scheduled session will be charged 50% of the hours originally reserved. CONFIRMED sessions that are cancelled or postponed within 24 business hours of a scheduled session will be charged 100% of the hours originally reserved. If Red Amp Audio is able to resell the cancelled time, the Client will not be charged for the time that is resold. Sessions that are challenged and then CONFIRMED may not be cancelled.
Tapes, CDs, DVDs, Drives, Files and all other materials received by Red Amp for use on a Client’s project are the responsibility of the Client and if left at the studio are done so at the Client's risk. The Client is responsible for the accuracy and completeness of their project. The Client is solely responsible for the copyright and licensing of property used in their project. The Client agrees to indemnify Red Amp Audio, its agents and suppliers, holding them free from any and all liabilities and expenses in connection with services and/or materials provided to or by Red Amp Audio.
Once a project is complete or there has been inactivity on a project for more than two months, the project must be archived or it will be deleted. If the Client wishes to archive the project, the Client must provide a Mac-compatible hard drive or jump drive. Red Amp will then transfer all of the project files and session files to the Client’s drive. After all of the files have been transferred to the Client’s drive and the drive has been checked for completeness, Red Amp Audio will delete the project and will no longer have any files associated with that project. The Client’s archived drive is the sole responsibility of the Client and it is recommended that the Client make a second backup of their project.
Payment in full is due at the end of each session and must be received before any files will be released. All invoices are due upon receipt. A late payment penalty of 3% per month, which is the equivalent of 36% per year will be charged on the balance remaining unpaid 30 days after the date of the invoice. Third party collections are not the responsibility of Red Amp Audio. Red Amp Audio may hold a Client's property, including but not limited to items such as masters, session files or any other property, until the Client has paid, in full, any bills that are due.
Marketing & Promotion:
Red Amp Audio has the right to use a Client's project for its own marketing, advertising, promotion and exhibition, both internally and externally. Red Amp Audio shall not make any commercial sale of a Client’s project without the written permission of the Client.
This Agreement incorporates the entire understanding of the Client and Red Amp Audio. Any modifications of this Agreement must be in writing and signed by both parties. This Agreement is governed by the laws of the State of Virginia.
