FlexCare Medical Staffing (“Company”) conducts background checks in accordance with state and federal law. This document sets forth the process the Company uses for background checks once an offer for an assignment has been accepted and the contract has been signed. The Company will complete a background check using this process at time of hire and annually thereafter at a minimum, which could include, prior to each new facility assignment, or if returning to the same facility having not worked for over 90 days.
Should the background check reveal any of the following convictions within the last seven years, a further individualized review by Human Resources will be conducted before placing a nurse on assignment. This list is not meant to be all inclusive:
a. Violent crimes or crimes against a person. Examples include but are not limited to:
i. Felony assault
ii. Battery
iii. Domestic violence
iv. Sexual assault
v. Sexual offenses
vi. Felony theft
vii. Manslaughter
viii. Murder
ix. False imprisonment
x. Kidnapping
xi. Lewd/lascivious acts
xii. Human trafficking
xiii. Workplace violence
b. Crimes relating to controlled substances, health care or certain property crimes. Examples include but are not limited to:
i. Felony possession (without certificate of rehabilitation), possession for sale, sale or use of illegal or controlled substances (i.e. narcotics), excluding certain misdemeanor marijuana-related offenses
ii. Vandalism, breaking/entering, destruction of property
iii. Theft, larceny, fraud, forgery, identity theft or misuse of electronic data
iv. Class A and Class B misdemeanor theft
v. Health care related criminal convictions in federal or state court
c. Currently on parole, probation, conditional release or serving weekend sentence (depending on crime committed)
d. Civil judgments for the following types of offenses (not all-inclusive):
i. Health care related civil judgments in federal or state court
ii. Misuse of electronic media
iii. Fraud
e. Any social security trace where the SSN was reported used in a death benefits claim
f. Any outstanding warrants
g. Criminal convictions, depending on severity, older than 7 years (i.e. a felony with a failing disposition that is greater than 7 years old)
h. Multiple convictions for misdemeanors (if minor, non-job related)
i. Conviction of two or more DUI/DWI’s within the past three years, and other drug or alcohol offenses without certificate of rehabilitation.
j. Any other finding determined to be significant enough for further review.
k. Healthcare License Disciplinary Actions or Investigations
In addition, if you are convicted of any crime while employed by the Company, or are notified that your license is under investigation, or there is disciplinary action placed on your license, while employed by the Company, you are required to inform Human Resources within five days of your conviction. At that time, an individualized review will be completed on your standing with the Company.
By signing the below you acknowledge that you understand FlexCare Medical Staffing’s background check process and agree to report any criminal convictions or civil judgments for the offenses listed in section (d), above, during your employment.
