Agreement Terms
The exclusive use of New Era Towing by the party named above shall commence on the date of this contract. This contract is valid for 1 year starting from the commencement date and will automatically renew indefinitely after the one year period. Cancellation by either party is available after the one year date upon a thirty (30) day written notice delivered by Certified U.S. Mail. Property agrees to allow New Era Towing up to thirty (30) business days to remove the signs provided Property. Property and New Era Towing further agree that the full agreement remains in place during the thirty-day (30) cancellation period. The property and New Era Towing agree that cancellation will only be effective if delivered by US Mail First Class Certified Return Receipt. *

Owner/Management agrees that New Era Towing and affiliates shall be the exclusive towing services during the terms of this Agreement for this parking facility stated above. New Era Towing agrees to indemnify Owner and it's agents, employees, affiliates, successors, and assigns from any claims, loss, or cost (including reasonable attorney's fees) arising from and related to any service performed under this agreement by New Era Towing. In the event a vehicle is towed by New Era Towing, llc. by mistake by either party, at the request of the Owner/Management the vehicle owner may recover the vehicle within (24) hours of the tow at no charge. No vehicle will be releasedfree of charge after (24) hours of the tow. In no event will the vehicle be towed back to the parking facility. *

For and in consideration of allowing New Era Towing to enter the Property for the purpose of removal of unauthorized, abandoned or illegally parked vehicles and other related services, the receipt and sufficiency of which is acknowledged by New Era Towing and New Era Towing’s agent’s signature hereto. This legally binding agreement gives New Era Towing the authority and written permission to enter upon the Property and remove any vehicle deemed unauthorized, abandoned, inoperable or illegally parked by the parking facility owner/property owners’ association for the reasons set forth in this agreement. This Agreement gives New Era Towing the authority to act as agent of and on behalf of the above referenced property owner or management for the purposes of defending the legality and validity of a tow in a hearing in any Justice of the Peace court having jurisdiction over the case in compliance with Texas Occupations Code 2308 subchapter J. *

New Era Towing will assume all responsibilities in the notification of law enforcement agencies in reporting this impoundment of vehicles from said “Property” as required by Texas Occupation Code Section 2308.056, Subchapter B. Any changes in parking enforcement procedures, such as placing the property on a temporary hold, additional vehicles allowed to park, or enforcement times not included on the original binding agreement and/or addendum must be sent via electronic mail (e-mail) or faxed. *

New Era Towing will follow all laws and statutes set by the State of Texas and any additional Local laws set forth in any ordinance of each municipality. In accordance with Texas Administrative Code 86.705, signs will be provided by New Era Towing to be installed in accordance with the law. Initiation of this contract by the parking facility owner/property owners’ association is a written conveyance to New Era Towing that: (A) the parking facility owner/property owners’ association has installed signs required by Section 2308.252(a)(1); or (B) the vehicle owner or operator received notice under Section 2308.252(a)(2); or (C) the parking facility owner/property owners’ association gave notice complying with Section 2308.252(a)(3) prior to any tow request being made. *

I certify that I am authorized to execute this binding agreement on behalf of the property owner, and/or Management Company with New Era Towing I also proclaim that New Era Towing has not offered any gifts, free services, free products, commissions or the promise of any gifts for the use of their services. Offering gifts is against the State of Texas law and New Era Towing will not condone any such actions. This agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings or agreements, whether written or oral. No amendment to or modification of this agreement will be binding unless in writing, properly dated, and signed by both parties. *
